1. Agreement to these Terms

These Terms of Use (“Terms”) form a legally binding agreement between you (“you”, “user”) and the operator of Cal Scan (the “Operator”, “we”, “us”, or “our”).

By downloading, installing, accessing, or using Cal Scan (including guest / anonymous use), you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

If you use the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Who may use Cal Scan

2.1 You must be at least 13 years of age (or the higher minimum age required in your country) to use the App. 2.2 If you are between 13 and the age of legal majority where you live, you may use the App only with the consent of a parent or legal guardian who agrees to these Terms. 2.3 The App is not directed to children under 13. We do not knowingly create accounts for children under 13. 2.4 You must be able to form a binding contract and must not be prohibited from receiving the Service under applicable law.

3. Description of the Service

Cal Scan is a consumer lifestyle application that helps you estimate and log nutrition-related information and related daily habits. Features may include, without limitation:

We may add, change, suspend, or remove features. Availability may differ by platform, region, account type (guest vs signed-in), membership status, and device capability.

4. Important health and nutrition disclaimer

Cal Scan is not a medical device and does not provide medical, clinical, diagnostic, or dietary treatment advice.

4.1 All calorie estimates, macronutrient estimates, BMI-related figures, goal dates, AI meal recognition results, barcode / database matches, and health-plan outputs are approximate informational estimates only. They may be incomplete, inaccurate, or unsuitable for your personal situation. 4.2 The App does not replace advice from a physician, registered dietitian, or other qualified professional. Do not disregard professional advice or delay seeking it because of something you saw in the App. 4.3 If you have a medical condition (including eating disorders, diabetes, pregnancy, kidney disease, or other metabolic conditions), are under clinical supervision, or are under 18, consult a qualified professional before relying on calorie or diet targets. 4.4 AI and third-party data sources can be wrong. Meal photos may be misidentified; Open Food Facts or other catalogue data may be outdated or incorrect; manual estimates may be wrong. You are responsible for verifying information that matters to you before acting on it. 4.5 We are not responsible for any health outcome, injury, or loss arising from reliance on estimates or plans generated by the App.

5. Accounts, guest use, and eligibility

5.1 You may use limited features as a guest (anonymous / device-linked session) or after creating / signing into an account. 5.2 You are responsible for the accuracy of information you provide and for keeping login credentials confidential. Notify us promptly at [email protected] if you suspect unauthorised access. 5.3 Signing in does not by itself grant Premium membership. Membership is determined by a valid subscription or other entitlement we recognise. 5.4 You may delete guest data or delete your account through in-app flows where available. Deleting the App, clearing local data, deleting guest data, or deleting an account does not cancel an App Store or Google Play subscription. You must manage or cancel subscriptions in the applicable store account settings. 5.5 We may refuse, suspend, or terminate access if we reasonably believe you violate these Terms, create risk or legal exposure for us or others, or misuse the Service.

6. Licence to use the App

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the App on devices you own or control, solely for your personal, non-commercial use, in accordance with App Store / Google Play rules and these Terms.

You must not (and must not attempt to):

All rights not expressly granted are reserved by us and our licensors.

7. User content and meal images

7.1 “User Content” means content you submit, including meal photos, barcodes, food names, notes, diary entries, water / exercise / weight logs, favourites, questionnaire answers, and profile information. 7.2 You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, display, and create derivative technical outputs (e.g. nutrition estimates) from User Content solely to operate, secure, improve, and provide the Service, including AI-assisted recognition via our servers and subprocessors, as described in the Privacy Policy. 7.3 You represent that you have all rights needed to submit User Content and that doing so does not violate law or third-party rights. 7.4 Do not upload images of other people without appropriate rights or consent where required. Prefer photos of food only. 7.5 We may remove User Content that we reasonably believe violates these Terms or law.

8. AI-assisted features and usage limits

8.1 Certain features (including camera / gallery meal recognition and related “re-analyse” flows) use automated systems, which may include third-party AI model providers processing inputs on our behalf. 8.2 Free users may be subject to daily quotas (e.g. limited AI recognitions or water logs per local calendar day). Premium features and higher limits are described in-app and may change. 8.3 Quotas are typically counted when a valid result is produced; cancelled or failed attempts may not consume a quota, as implemented in the product. Quotas may be associated with your account and/or device session and are not a guaranteed service level. 8.4 AI outputs are probabilistic. You should review and edit results before saving them as your log.

9. Food databases and third-party information

Barcode lookup and search may use Open Food Facts and/or other food product databases and our own catalogues. Those sources are provided by third parties or community contributors. We do not warrant their completeness or accuracy. Matching a barcode does not guarantee that the product in your hand matches the database entry (reformulations, regional variants, and packaging differences occur).

10. Subscriptions, trials, and payments

10.1 Premium access may be offered via auto-renewing subscriptions (e.g. monthly, yearly, weekly) and promotional or retention offers. Exact prices, trial length, and local currency are shown in the App and confirmed by Apple or Google at purchase. 10.2 Payments are processed by Apple App Store or Google Play, not directly by us. Their terms, refund policies, and tax rules apply to the purchase transaction. 10.3 Unless you cancel at least 24 hours before the end of the current period (or as otherwise required by the store), subscriptions auto-renew and your store account will be charged. Manage or cancel in:

10.4 Deleting the App or your Cal Scan account does not cancel the store subscription. 10.5 Free trials, introductory prices, and win-back / gift offers are subject to store eligibility rules. We may use remote configuration to decide whether certain offers are shown. 10.6 Refund requests for store purchases must generally be made through Apple or Google. We may assist with entitlement questions at [email protected] but cannot override store payment systems. 10.7 If your subscription expires, Premium features may lock. Historical data is generally retained according to the Privacy Policy and product rules, but Premium-only features may remain inaccessible until you re-subscribe.

Where Apple’s Licensed Application End User Licence Agreement (“Apple EULA”) applies, it also governs your use of the iOS App; in case of conflict on Apple’s mandatory terms, Apple’s terms control for that subject matter.

11. Notifications and device permissions

The App may request access to:

You may deny or revoke permissions in system settings; some features will then be unavailable. Reminder schedules are your responsibility to manage.

12. Intellectual property

The App, branding (including “Cal Scan” / “CalScan”), UI, software, logos, and original content (excluding User Content and third-party databases) are owned by us or our licensors and protected by intellectual property laws. These Terms do not transfer ownership to you.

13. Third-party services

The Service may rely on third parties such as cloud hosting, authentication providers, app stores, analytics / attribution partners, email delivery, push notification infrastructure, AI model providers, and food data providers. Your use of those services may also be subject to their terms. We are not responsible for third-party services we do not control, except as required by applicable law.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ESTIMATES OR AI RESULTS WILL BE ACCURATE.

Some jurisdictions do not allow certain disclaimers; in those places, disclaimers apply only to the fullest extent permitted.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, DIRECTORS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID US (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM; OR (B) USD 50.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (including liability for death or personal injury caused by negligence where such exclusion is forbidden, or for fraud).

16. Indemnity

To the extent permitted by law, you agree to defend and indemnify us against claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your misuse of the Service, or your violation of these Terms or applicable law.

17. Suspension and termination

You may stop using the App at any time. We may suspend or terminate access immediately if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by nature should survive (including intellectual property, disclaimers, liability limits, indemnity, and governing law) will survive termination.

18. Changes to the Service or Terms

We may update these Terms. The “Last updated” date will change when we do. Material changes will be communicated by in-app notice, website posting, or other reasonable means. Continued use after the effective date constitutes acceptance, except where additional consent is required by law.

19. Export and sanctions compliance

You must comply with applicable export control and sanctions laws. You may not use the App if you are prohibited from doing so under those laws.

20. Governing law and disputes

Unless a mandatory local consumer law provides otherwise, these Terms are governed by the laws of the jurisdiction where the Operator is established (to be specified upon publication), without regard to conflict-of-law rules.

Consumers in the European Economic Area, United Kingdom, and similar regions retain mandatory rights under local consumer protection law. Nothing in these Terms limits those non-waivable rights.

If a dispute arises, contact [email protected] first so we can try to resolve it informally.

21. Apple-specific terms (iOS)

If you obtained the App from the Apple App Store:

22. Google Play-specific terms (Android)

If you obtained the App from Google Play, your use is also subject to Google Play’s terms and policies. Billing and cancellation for subscriptions purchased on Google Play are handled through Google.

24. Entire agreement

These Terms, together with the Privacy Policy and any in-app disclosures required by law (including subscription purchase sheets), constitute the entire agreement between you and us regarding the Service and supersede prior understandings on the same subject. If any provision is held unenforceable, the remaining provisions remain in effect.
